Welcome to the World Friendship Ambassador programme (“WFA”), a video-on-demand service provided by Bigfoot Arts Education. WFA offers educational content that promotes Kindness, Equity & Belonging in your school through streamed video content and downloadable resources. These Terms and Conditions (“Terms”) govern your use of our service. By accessing or using WFA, you agree to be bound by these Terms.
• “Service” refers to the WFA platform, including all content, features, and functionality.
• “Content” refers to the videos, series, episodes, and related materials provided through the Service.
• “User” refers to the individual teacher or staff member using the Service within a subscribed school.
• “School,” “you” or “your”” refers to the educational institution that subscribes to WFA, allowing its Users access to the Service.
• “We,” “us,” or “our” refers to Bigfoot Arts Education, the provider of the Service.
• 3.1 School Subscription: The Service operates on a yearly subscription model. A subscription covers the entire school, allowing nominated Users within the school to create individual accounts and access the Service.
• 3.2 Account Registration: Each User must create an individual account to access the Service. Account information must be kept confidential, and you are responsible for all activities that occur under any such account.
• 3.3 Trial Period: We may offer a set trial period for schools to explore the Service at no cost, subject to separate User agreement.
• 3.4 Cancellation: A school may cancel its subscription at any time. However, no refunds will be issued for the unused portion of the subscription.
• 4.1 Educational Use: The Content is intended for use in primary school classrooms. Users may use the Content solely for educational purposes with their students. The school is responsible for providing a suitable space for classes or groups to safely watch the service. Bigfoot Arts Education shall not be held liable for any damage or injury sustained during participation in the Services.
• 4.2 Access Restrictions: Users may not share their account login information with others outside of their school, nor allow unauthorised individuals to access the Service. Each subscription is intended for use by the subscribing school only.
• 4.3 Content Restrictions: You may not, and shall not permit third party including Users, to, copy, reproduce, distribute, modify, or create derivative works based on the Content, except as expressly permitted by these Terms or with our written consent.
• 5.1 Ownership: All Content, including videos, series, episodes, graphics, logos, and other materials, is the intellectual property of Bigfoot Arts Education or its licensors. The Content is protected by copyright, trademark, and other intellectual property laws.
• 5.2 License: Upon subscribing, we grant the School a limited, non-exclusive, non-transferable license to access and use, and to permit its Users to access and use, the Content for educational purposes in accordance with these Terms.
• 6.1 New Content: We regularly add new content to the Service. A school’s subscription includes access to all new Content added during the subscription period.
• 6.2 Content Availability: We reserve the right to modify, suspend, or discontinue any aspect of the Service or Content at any time without notice or liability.
• 7.1 Responsibility: You are responsible for ensuring that your Users comply with these Terms. Any misuse of the Service by a User is your responsibility.
• 7.2 Prohibited Activities: You agree not to engage in or permit any activity that could harm the Service, including but not limited to:
• Attempting to gain unauthorized access to the Service.
• Circumventing any security features of the Service.
• Using the Service for any illegal or unauthorised purpose.
• 7.3 Reporting Violations: If you become aware of any misuse or violation of these Terms, please report it to wfa@bigfootartseducation.co.uk
Your use of the Service is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information and that of Users. By subscribing to the Service, you consent, and procure the consent of all Users, to the practices described in the Privacy Policy.
• 9.1 No Warranty: The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
• 9.2 Limitation of Liability: To the maximum extent permitted by law, Bigfoot Arts Education shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your and your Users use of the Service.
You agree to indemnify and hold harmless Bigfoot Arts Education, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your and/or your Users’ use of the Service or your violation of these Terms.
• 11.1 These Terms will be governed by and construed in accordance with English law, and any disputes relating to these Terms will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
• 11.2 Any disputes arising from or related to these Terms or the Service shall be settled by the matter being promptly referred to a senior executive from each of the parties, authorised to agree a solution. The senior executives shall have 30 days from the raising of the disagreement to discuss and resolve the matter. If the senior executives cannot resolve the matter it shall be referred for resolution to an arbitrator from the London Court of International Arbitration agreed by the parties. The expert shall act as an amicable mediator and each of the parties shall in good faith co-operate with his reasonable requests. If the expert is unable to mediate a resolution within 60 days of his appointment, either of the parties may resort to formal legal action
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the Service. The School’s continued use of the Service after such changes constitutes your acceptance of the new Terms. Please check this page regularly to ensure you are familiar with the current version.

• 3.2 Duration: The free trial period is limited. After this period, your access to the Service will expire unless your school subscribes to the Service.
• 3.3 No Obligation: There is no obligation to purchase a subscription at the end of your free trial. However, if your school decides to subscribe, you may continue using your account under the school’s subscription.
• 3.4 Transition to Subscription: If your school subscribes to WFA during or after your free trial, your account will be transitioned to the school’s subscription plan.
